Dr Haidar Hoballah publishes an article on “Islamic Political Jurisprudence in Light of the Theory of the Objectives of Sharia” as part of a new book published by the 𝐀𝐥-𝐁𝐚𝐲𝐝𝐚𝐫 𝐂𝐞𝐧𝐭𝐫𝐞 𝐟𝐨𝐫 𝐒𝐭𝐮𝐝𝐢𝐞𝐬 𝐚𝐧𝐝 𝐏𝐥𝐚𝐧𝐧𝐢𝐧𝐠 in Baghdad, titled: “𝐈𝐬𝐥𝐚𝐦𝐢𝐜 𝐏𝐨𝐥𝐢𝐭𝐢c𝐚𝐥 𝐓𝐡𝐨𝐮𝐠𝐡𝐭: 𝐁𝐞𝐭𝐰𝐞𝐞𝐧 𝐓𝐫𝐚𝐝𝐢𝐭𝐢𝐨𝐧 𝐚𝐧𝐝 𝐭𝐡𝐞 𝐂𝐡𝐚𝐥𝐥𝐞𝐧𝐠𝐞𝐬 𝐨𝐟 𝐭𝐡𝐞 𝐌𝐨𝐝𝐞𝐫𝐧 𝐀𝐠𝐞.”
The volume brings together contributions from a distinguished group of academic researchers exploring the evolving landscape of Islamic political thought. In this article, Dr Haidar Hobballah examines three distinct perspectives on reconciling Sharīʿah with the modern state and its normative frameworks:
– The classical scholastic position upheld by traditional religious institutions
– The theory of Wilāyat al-Faqīh and its corresponding jurisprudential model
– A third approach grounded in the dual principles of Maqāṣid al-Sharīʿah (the higher objectives of Islamic law) and an acknowledgment of the non-comprehensive nature of Sharīʿah in certain domains
While critically engaging with the first two approaches, he proposes this third framework as offering a more coherent and adaptable basis for aligning Islamic jurisprudence with the political realities and values of the contemporary age.
